Under Section 501 of the Migration Act 1958, the Department of Home Affairs must be satisfied you meet Australia's strict character standards. This isn't just about avoiding serious criminal history; it's about demonstrating you're someone who aligns with community safety, lawfulness, and the values Australia expects from those joining its workforce and society.

The Legal Framework

Section 501 empowers the Department (or Minister) to refuse or cancel a visa if you fail the character test. 

The test has two stages:

• First, determining whether you pass the test.
• Second, if you don't, exercising discretion — weighing whether to refuse/cancel anyway, considering factors like community protection and your ties to Australia.

Ministerial Direction 99 (Current in 2026)

Decision-makers follow Ministerial Direction 99 (issued 2024), which sets a clear hierarchy of considerations. 

The primary focus is always protection of the Australian community from criminal or other risk. 

Other factors include:

• The best interests of any minor children affected
• The expectations of the Australian community (e.g., serious offending is generally unacceptable)
• The strength, nature, and duration of your ties to Australia (family, employment, community contributions)

This direction balances national security with recognition of long-term residents' or skilled contributors' connections.

How You Fail the Character Test

You automatically fail under s 501(6) if you have a substantial criminal record, defined as:

• A sentence of imprisonment for 12 months or more (including cumulative sentences or suspended sentences)
• A life sentence
• Convictions for sexually based offences involving a child

Even without a substantial record, you can fail if:

• You have been convicted of (or charged with) offences involving violence, fraud, or other serious conduct
• You associate with people/groups involved in criminal activity
• You have a history of domestic violence, intervention order breaches, or patterns suggesting disregard for the law
• There are reasonable grounds to believe you'd pose a risk to the community (e.g., through behaviour, online activity, or security concerns)

Foreign convictions count, as do spent convictions and some juvenile offences (disclosable under migration law). 

Recent policy emphasises forward-looking risk — including social media posts showing extremist views, hate speech, or disregard for laws.

Security and Risk Profiling

The Department cross-checks with Australian Federal Police, INTERPOL, Five Eyes partners, and other agencies. Skilled applicants in sensitive sectors (e.g., critical infrastructure, defence, telecommunications, energy) face heightened scrutiny for national security risks.

What You Must Provide

• Police clearance certificates from every country you've lived in for 12+ months over the last 10 years (translated if needed)
• Form 80 (Personal Particulars for Assessment) — full 20-year residential, employment, and travel history
• Military service records (if applicable)
• Explanations for any adverse matters (e.g., dropped charges, regulatory breaches, civil judgments)

The Department may request more: court transcripts, psychological reports, character references from employers/community leaders, or evidence of rehabilitation (e.g., completed courses, clean record post-offence).

The Visa Applicant Character Consideration Unit (VACCU)

Complex or flagged cases go to VACCU for specialist review. They use analytics, open-source intelligence, and databases to assess patterns like repeated traffic offences, unexplained employment gaps, or financial irregularities.

Processing Times and Communication

Standard checks take 4–8 weeks, but complex/international cases can extend to 12–18 months. You'll receive:

• A Natural Justice Letter if concerns arise (with 28 days to respond)
• Requests for interviews or additional evidence

Consequences of Failing

Failure leads to visa refusal (new applications) or cancellation (existing visas), often with exclusion periods (3 years to lifetime). High-risk cases can trigger mandatory detention (s 189) and removal. Recent data shows many refusals stem from undisclosed minor matters rather than major crimes.

How to Strengthen Your Application

• Disclose everything fully — the duty of candour is strict; omissions can cause refusal even if the underlying issue is minor
• Provide rehabilitation evidence (e.g., clean driving record, completed programs, employer letters)
• Highlight positive factors: employment contributions, community involvement, family ties
• For drink-driving or minor offences: show 5+ years clean record, responsible behaviour courses, or interlock device use
• Use NAATI-certified translations for foreign documents

Review Options

If refused, onshore applicants usually have merits review rights at the Administrative Review Tribunal (ART) — lodge within 21 days (or 7 in some cases). Offshore applicants often have limited/no review rights but can re-apply with stronger evidence. Ministerial intervention (s 351) is rare but possible for compelling cases.
